This End-User License Agreement ("EULA") is a legal agreement between you (the person or company who is being licensed to use the "Software" or documentation) and Tataragne Interactive (hereinafter we/us/our).
This EULA agreement governs your acquisition and use of all Products, Software, Scripts or Services you purchase directly from Tataragne Interactive or indirectly through a Tataragne Interactive authorized reseller or distributor (a "Reseller").
Please read this EULA agreement carefully before purchasing and completing the installation process and using the Tataragne Interactive Softwares or Services. It provides a license to use the Tataragne Interactive Softwares or Services and contains warranty information and liability disclaimers.
Tataragne Interactive reserves the right to change this EULA agreement at any time and impose its clauses at any given time.
By purchasing the Tataragne Interactive Softwares or Services, you are confirming your acceptance of the Software or Services and agreeing to become bound by the terms of this EULA agreement.
If you are entering into this EULA agreement on behalf of a company or other legal entity, you represent that you have the authority to bind such entity and its affiliates to these terms and conditions. If you do not have such authority or if you do not agree with the terms and conditions of this EULA agreement, do not install or use the Software or Services, and you must not accept this EULA agreement.
This EULA agreement shall apply only to the Software supplied by Tataragne Interactive herewith regardless of whether other software is referred to or described herein. The terms also apply to any Tataragne Interactive updates, supplements, Internet-based services, and support services for the Software, unless other terms accompany those items on delivery. If so, those terms apply.
Tataragne Interactive reserve the right to publish a selected list of users of our Software.
Tataragne Interactive will not be liable to you for any damages (including any loss of profits/saving, or incidental or consequential) caused to you, your information and your business arising out of the use or inability to use this Software.
Tataragne Interactive is not liable for prosecution arising from use of the Software against law or for any illegal use.
If you fail to use the Software in accordance with the terms and conditions of this EULA agreement it constitutes a breach of the agreement, and your credentials to use the program are revoked.
Tataragne Interactive hereby grants you, non-transferable, non-exclusive licence to use the Tataragne Interactive Softwares for personal or business use, in accordance with the terms of this EULA agreement.
You are permitted to install the Tataragne Interactive Softwares under your control. You are responsible for ensuring your project meets the minimum requirements of the Tataragne Interactive Softwares.
This EULA agreement gives you the right to use only one copy of the Software on one domain solely for your own personal or business use on a single production Sylius installation, subject to all other terms of this Agreement. A separate credentials should be purchased for each new Software installation. Any distribution of the Software without Tataragne Interactive consent, including noncommercial distribution is regarded as violation of this EULA agreement and entails liability, according to the current law.
You are not permitted to:
- Edit, alter, modify, adapt, translate or otherwise change any part of the code in whole or part in any other software or product or website ; nor decompile, disassemble or reverse engineer the Software or attempt to do any such things
- Reproduce, copy, distribute, resell, sub-license, rent, lease or lend any portion or otherwise use the Software or the documentation to anyone for any commercial purpose
- Place the Software on a server so that it is accessible via a public network such as the Internet for distribution purposes
- Allow any third party to use the Software on behalf of or for the benefit of any third party
- Use the Software in any way which breaches any applicable local, national or international law
- Use the Software for any purpose that Tataragne Interactive considers is a breach of this EULA agreement
Intellectual Property and Ownership
Tataragne Interactive shall at all times retain ownership of the Software as originally downloaded by you and all subsequent downloads of the Software by you. The Softwares (and the copyright, and other intellectual property rights of whatever nature in the Softwares, including any modifications made thereto) are and shall remain the property of Tataragne Interactive.
Tataragne Interactive reserves the right to grant licences to use the Software to third parties.
Tataragne Interactive is the copyright holder of the Software. The Software or a portion of it is a copyrightable matter and is liable to protection by the law. Any activity that infringes terms of this Agreement violates copyright law and will be prosecuted according to the current law. We reserve the right to revoke the license of any user who is holding an invalid license.
This EULA agreement is effective from the date you first purchase the Software and shall continue until terminated. You may terminate it at any time upon written notice to Tataragne Interactive.
License agreement remains effective until terminated. Tataragne Interactive retain the right to terminate your license to use the Software at any time, if in its sole discretion, you are not abiding by the terms of the EULA agreement, including, but not limited to, obscuring or removing any link or copyright notice as specified in this agreement. You may terminate it at any time by destroying all copies of the Software. Termination of this Agreement does not bind us to return you the amount spent for purchase of the Software.
If you continue to use the Software after Tataragne Interactive gives you notice of termination of your license, you hereby agree to accept an injunction to enjoin you from its further use and to pay all costs (including but not limited to reasonable attorney fees) to enforce our revocation of your license and any damages suffered by us because of your misuse of the Software.
This EULA agreement, and any dispute arising out of or in connection with this EULA agreement, shall be governed by and construed in accordance with the laws of France.
